Description :
Whether temporary or permanent, OSHA guarantees that all workers always have a right to a safe and healthy workplace.
"Host employers need to treat temporary workers as they treat existing employees. Temporary staffing agencies and host employers share control over the employee, and are therefore jointly responsible for temp employee's safety and health. It is essential that both employers comply with all relevant OSHA requirements." - David Michaels, PhD, MPH, Assistant Secretary of Labor for Occupational Safety and Health
It is essential that both employers comply with all relevant OSHA requirements. However, who is responsible for what?
Temporary workers are considered more vulnerable to workplace safety and health hazards as they often “slip though the cracks” regarding safety training. These workers are often not given adequate safety and health training or explanations of their duties by either the temporary staffing agency or the host employer.
Temporary workers are especially vulnerable to retaliation from not just the host employer who temps worry will just “get rid of them” but that they may jeopardize their opportunity for future work from the temporary agency employer if they “make waves” by raising safety concerns or making complaints. So temporary workers are generally hesitant to speak up.
It’s always been important from a people perspective to keep all people safe at work. Nevertheless, currently it’s also imperative to know what OSHA considers the host employer responsibilities and what are the responsibilities of the staffing agency.
