Overview: Models other than employment can achieve significant alignment between hospitals and physicians. From paying the independent medical staff for improved quality results, to leasing the practice to the hospital on a professional services agreement, to co-management arrangements, there is a continuum of possibilities, all of which can be undertaken without liability under either Stark or the anti-kickback statute. This session will highlight the practical realities of engaging in these undertakings, including issues which should be addressed in the supporting contract documents.
Why should you attend: The mad dash to physician employment by hospitals has been noted by many. However, many of these transactions have been entered into with both little attention to the value proposition as well as unsustainable financial predicates. There are a range of other alignment strategies which can achieve all of the goals of employment without the difficulties of unwinding.
This presentation by an experienced attorney who has engaged in these alternative strategies throughout the country is both practical in terms of issues which must be addressed and insightful with respect to where things can go wrong.
