The US Department of Labor is making a concerted push to insure that employees are not improperly classified as Exempt when they should be classified as Non-exempt and thus eligible for overtime.
Companies that are subject to the Fair Labor Standards Act of 1938, which includes the majority of businesses in the US, should pay attention to the necessity of properly classifying employees as exempt employees. Making a mistake can cause companies to have to reclassify workers as and subsequently be required to pay back wages, taxes and penalties.
